Welcome to Lokuma.ai.

Lokuma.ai is an AI-powered internet software service provided by Tablize Tech, LLC, a Delaware limited liability company (hereinafter referred to as “Lokuma”, “we”, “us”, or “our”).

These Terms of Service (“Terms”) govern your access to and use of Lokuma.ai and all related services, features, software, websites, applications, APIs, and content (collectively, the “Services”).

Please read these Terms carefully before using the Services.

1. Agreement to These Terms

1.1 By accessing or using the Services, you confirm that you have read, understood, and agreed to be bound by these Terms, and that you have the legal capacity to enter into a binding agreement under applicable law. If you do not agree to any part of these Terms, you must immediately cease using the Services.

1.2 Certain provisions of these Terms, including those relating to AI features, limitations of liability, disclaimers, termination, intellectual property, and dispute resolution, are particularly important and are intended to protect Lokuma. You acknowledge that you have read and understood these provisions.

1.3 We may modify, update, or replace these Terms from time to time. Updated Terms will be posted on the Lokuma.ai website and will take effect upon posting. Your continued use of the Services constitutes acceptance of the updated Terms.

1.4 If you access or use the Services on behalf of an organization or third party, you represent and warrant that you are authorized to bind such entity to these Terms. In that case, “you” refers to that entity.

2. Services

2.1 The Services include, without limitation, AI-powered website generation, design tools, content generation, analytics, and other features made available by Lokuma from time to time.

2.2 We may change, suspend, or discontinue any part of the Services at any time, including free or paid features, without liability to you.

2.3 Free Services may be subject to limitations on functionality, usage, storage, or availability. Lokuma reserves the right to introduce fees for any free feature at any time, with reasonable notice where practicable.

2.4 We do not guarantee that the Services will be uninterrupted, error-free, or meet your specific requirements.

2.5 Certain features described on the website, pricing page, or marketing materials may be labeled as “in development,” “coming soon,” or similar. Such features are for informational purposes only and do not constitute binding commitments. Lokuma makes no guarantee that any such features will be implemented, released, or maintained within any specific timeframe, or at all.

3. Account Registration and Security

3.1 To access certain Services, you must register an account and provide accurate and current information. You are responsible for maintaining the confidentiality of your account credentials.

3.2 You are solely responsible for all activities that occur under your account, whether by you or by any person you authorize. Lokuma is not responsible for unauthorized access unless caused by our willful misconduct.

3.3 For organizational accounts, administrators may manage users, permissions, and access. Lokuma is not responsible for internal organizational disputes.

4. User Content and Conduct

4.1 You are solely responsible for any content you upload, input, generate, store, or share through the Services (“User Content”).

4.2 You represent and warrant that:

• You have all necessary rights and authorizations to use your User Content;
• Your User Content does not violate any laws or third-party rights;
• Your use of the Services complies with these Terms.

4.3 Lokuma does not pre-screen User Content but reserves the right to remove, restrict, or disable access to any User Content at its sole discretion.

4.4 You agree not to use the Services for illegal, harmful, infringing, deceptive, or abusive activities.

5. AI Features

5.1 Nature of AI Services Lokuma’s AI features are provided on an “as-is” and “as-available” basis, may contain errors or inaccuracies, and are not intended for mission-critical or production use. Lokuma makes no guarantees regarding accuracy, reliability, or suitability of AI-generated output.

5.2 Input and Output

• “Input” means any content you provide to the AI features.
• “Output” means content generated by the AI features based on Input.

You are solely responsible for both Input and Output, including ensuring compliance with applicable laws. Output is provided for reference only and does not constitute advice, endorsement, or representation by Lokuma.

5.3 Usage Restrictions You may not:

• Use AI Output to violate laws or third-party rights;
• Misrepresent AI Output as human-generated where prohibited;
• Use AI Output to train or develop competing AI systems;
• Reverse engineer, extract, or circumvent AI models or safeguards.

5.4 Model Training By using the AI features, you grant Lokuma a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use Input and Output to operate, maintain, improve, and develop the Services, including for model training and optimization purposes. By using the AI features, you acknowledge and agree that your Input, Output, and interactions with the Services may be used to train, enhance, improve, and develop Lokuma’s artificial intelligence models and related technologies (“Model Training”). Lokuma grants you the right to opt out of the use of your Input and Output for Model Training at any time by sending a written request to privacy@lokuma.ai. Once your opt-out request is effective, Lokuma will no longer use your Input and Output for Model Training based on your prior authorization. This opt-out does not affect processing necessary to provide, secure, or maintain the Services.

6. Intellectual Property

6.1 You retain ownership of your Input and User Content.

6.2 You grant Lokuma a worldwide, royalty-free license to host, store, process, display, and use your User Content as necessary to provide the Services.

6.3 As between you and Lokuma, and to the extent permitted by law, you own the Output. However, Lokuma does not guarantee that Output is unique, and similar or identical Output may be provided to other users.

6.4 All intellectual property rights in the Services, including software, models, templates, designs, and underlying technology, are owned by Lokuma or its licensors.

7. Fonts and Third-Party Materials

7.1 If you upload fonts or third-party materials, you represent and warrant that you have all necessary rights and licenses, including sublicensing rights.

7.2 You agree to indemnify Lokuma against any claims, damages, or losses arising from your use or upload of such materials.

7.3 Lokuma may remove any fonts or materials upon notice of alleged infringement, without prior notice.

8. Privacy and Data Protection

Your use of the Services is subject to the Lokuma Privacy Policy, which is incorporated by reference. For organizational users, Lokuma may act as a data processor on your behalf.

9. Data Security

Lokuma implements reasonable security measures but does not guarantee absolute security. You acknowledge the inherent risks of internet-based services. You are responsible for backing up your data.

10. Disclaimer of Warranties

To the maximum extent permitted by law, the Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied. Lokuma disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law:

• Lokuma shall not be liable for indirect, incidental, consequential, or punitive damages.
• Lokuma’s total liability shall not exceed the greater of
  • (i) USD 100 or
  • (ii) the fees paid by you to Lokuma in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Lokuma, its affiliates, and personnel from any claims, damages, losses, or expenses arising from:

• Your use of the Services;
• Your Input, Output, or User Content;
• Your violation of these Terms or applicable law.

13. Suspension and Termination

13.1 You may stop using the Services at any time.

13.2 Lokuma may suspend or terminate your access to the Services at any time, with or without notice, if:

• You violate these Terms;
• Your use poses a risk to the Services or others;
• Required by law or regulation.

13.3 Upon termination, Lokuma may delete your data after a reasonable retention period.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located within the State of Delaware, and the parties hereby consent to personal jurisdiction and venue therein.

15. Miscellaneous

• These Terms constitute the entire agreement between you and Lokuma.
• If any provision is unenforceable, the remainder remains effective.
• Lokuma may assign or transfer these Terms, in whole or in part, without restriction, in connection with a merger, acquisition, corporate reorganization, sale of assets, change of control, or other business transaction.

You acknowledge and agree that your continued use of the Services following such transfer constitutes acceptance of the assignment, and no additional consent is required.
